If you load the palette from within Photoshop CS4 it works fine, but if you double click on the file it doesn't work. Strange.

That's just the way these palettes work. They're not intended for display per se -- they're coded in a way that Photoshop and Adobe Illustrator recognize. You need to load them into the proper folder in PS or AI.
