@kingloko, doesn't your "Gold is Shiny" use one of the patterns created by isotope.151? I don't think that's allowed -- I believe you were supposed to use only the patterns listed under the category "RYZ Palettes", or create your own from scratch. ![]() ![]() kingloko kingloko 書いた: 6 07月, 2009

The thing is, you have to click the button that says something like "This is my own design". But it wasn't your design, it was isotope.151's design. COLOURlovers had authorized some patterns to be used, but not this one. I see this has happened several times in the RYZ contest -- people submitting other COLOURlovers designs. I have no idea what the judges are going to do about it. ![]()

It was 'for the love of patterns', with a highlight on CL. The "This is my own design" irritated me too. Since we can download the patterns here without being logged in, I tried to think of this as- 'yes, this is my own colour scheme of it'. I dare to speculate that the creators (like Isotope) gave the rights to the CL community- otherwise you'd have to log in and sign a 'terms of use' contract, before using it . And -as I already mentioned- you can download the patterns freely. It's the same as with 'magic' and 'D&D', I think. For the contest it's allowed to use it, without having to worry who the illustrator was. I do understand what your point is. It's just about the interpretation. Fact is: the RYZ-crew isn't really strict in executing their rules (still almost 700 entries) or in giving clear directions (for lay-people or first-time-visitors as I am it's a jungle and it's really hard to collect all the needed information). I see the site is a beta, but many things need to be improved for it to work smooth and without misinterpretations... It has a great potential though. However: good luck to all of you! The rules concerning which patterns were available for use in the contest were spelled out in this blog post. Thank you bunigrl33. Now I don't understand, as someone on RYZ said: why didn't they simply disqualify the shoes? This is a serious problem then. I agree, the rules haven't been really clear all along. I guess most of us at CL knew our patterns are copyrighted, but many of you guys didn't. Gosh, I wonder how the judges are going to straighten this one out. Thank you, GreenMyEyes. For the sake of justice and peace I did it already. So I'm out of the run now :) I still can't figure out how the copyright thing works..because: if someone takes the pattern out of CL, he doesn't have to sign anything, no agreement or contract. If you don't agree on something, you legaly (not talking about ethics here) aren't bound to obey any rules, I guess. This actually means this: if someone not registered to CL downloads a pattern I made the colours for, uses the work of the pattern designer & my colour design. So 'work' of two people. But he never had to agree/disagree on anything. This was my starting point when thinking about this subject- that's why I thought this is only possible if the patternmaker and the colourdesigner both agree to give all the rights to CL. Obviously I'm wrong here or don't know the US legal sistem well enough. Would anybody (please) be kind enough to explain where I went wrong with my line of logical construction? Thank you in advance! @ksantipa, I don't really know what to tell you. But normally someone isn't able to download patterns from COLOURlovers. I think it's just a fluke of the contest related to downloading a template. This is from the FAQ about terms of use: Pattern templates i.e. the original pattern files are copyrighted. If you want to use them for commercial purposes, you will need to find who created the pattern and contact them to see what their terms of use are. I don't know much about the subject myself, but there's a long article on copyrights in Wikipedia. Nowhere does it talk about the user having to sign a contract. It appears that the owner of a copyright still owns the copyright even if a user is not aware of that. Go figure. In the case of COLOURlovers: the site does contain notification that the patterns are copyrighted (see above); and it was spelled out in the rules of the contest -- that only certain patterns were approved for use. I can understand that some people didn't read the rules carefully or were mislead by what others were doing, but I do think those shoes should be disqualified. I think we'll just have to let the judges at COLOURlovers work it out with the judges at RYZ. I fully agree with the perception, that It appears that the owner of a copyright still owns the copyright even if a user is not aware of that.At least it should be that way, to save the intellectual property of the creator. The twist here is the fact, that I'm a 100%sure - I could download the patterns without being logged in - and that even before the RYZ contest. This is why I always thought I could use the pattern freely- as long as I don't claim it is solely mine. I didn't go to check again, since I never planned to use them. But after seeing some shoes made with non-RYZ templates out of CL patterns, I thought it's OK. That was wrong- and I agree about disqualifying those entries anyway, even if I wouldn't do it myself. The grotesque part here: it was the CL jury which picked me as a finalist...not the RYZ jury. (I do understand that the RYZ team didn't recognise the patterns and that's why they were unintentionally misleading the contestants by their approval.) We all (RYZ, CL, me & some others) made mistakes. I was just hoping somebody from RYZ or CLwould give some replies to these events. It seemes I'm the only one doing the talking. I also think it was lot's of fun. Let those problems stay far away from now on. Thanks again to all the Colour-Lovers which gave comments to this subject and helped me understand it a bit better. @ksantipa. I don't know what to tell you. I tried to color a pattern without logging in and, although I could color it, I couldn't save it. And I know if you go to a pattern and click on one of the Get this pattern links, you can copy a pattern and then paste it into Paint, or Photoshop, or Illustrator, but all you'll get is a pixilated pattern -- you won't get the vector image. So, again, I think it was just a fluke of the contest that allowed people to play with these patterns. I, too, so wish that someone from RYZ would respond to this issue. I've notified one of our CL judges, and maybe something will happen. ![]() ![]() |
